Based on articles 15 and 16 of the Federal Law on Protection of Personal Data Held by Private Parties (the “Law”) and its regulations in Mexico, we inform you that Prestadora de Servicios MT, SA de CV, its subsidiaries, affiliates, affiliates, controllers and/or associates (hereinafter "Marhnos"), with address at San José number 167, Colonia San Martín Xochinahuac, Alcaldía Azcapotzalco, Postal Code 02120 in Mexico City, is responsible for collecting personal data, the use that is give them and their protection (the "Personal Data"), in compliance with the principles of legality, quality, consent, information, purpose, loyalty, proportionality, and responsibility.
Candidates for jobs and/or service providers and/or commission agents and/or individuals and/or legal entities, whatever their nature and relationship with Marhnos; provide Personal Data to Marhnos directly, indirectly (for example public access data), personally, or through its subsidiaries, affiliates, controllers and/or associates and/or business allies.
Personal Data is collected through: i) public access database (for example OCC, Bumeran, university job boards, federal and local government job boards, among others), ii) corporate offices, iii) website iv) telephone and/or email, and v) through any other means of communication provided by Marhnos to the owner of personal data (for example, electronic forms and/or physical documents). The data that is collected may include: (a) name (s) and surnames; (b) gender; (c) nationality; (d) domicile; (e) email address; (f) telephone numbers (home and / or cell); (g) place and date of birth; (h) age; (i) marital status; (j) hobbies; (k) details of relatives (name (s) and surnames, age, address, date of birth and if your father, mother or common-law spouse, partner (s) and child (ren) work within Marhnos, and / or subsidiaries, affiliates, affiliates, controllers, business allies, employees, service providers , your partners, with whom we have or do business; (l) details of beneficiaries in the event of death (name (s) and surnames, age, occupation, address and telephone numbers (home and / or cell phone)); (m) personal references (name, address and telephone number (home and / or cell), if applicable; (n) academic data (dates and educational institutions); (ñ) employment information (address, experience, telephone number, references of former jobs, if applicable and contact information); (o) photograph; (p) general information and health status (diseases, illnesses, allergies and phobias) (p1) specific information related to health status, for example: personal medical symptoms in the last 14 days, personal information about contact with third parties with contagion or suspected contagion of Covid 19; information on regular contact with third parties with a high potential for contagion against Covid 19; (q) unique population registry key; (r) key of the federal registry of taxpayers; (s) number of affiliation to social security systems; (t) bank account number for payment; (u) number and type of driver's license; (v) availability to travel and / or change residence; (w) information regarding monthly income and / or expenses; (x) patrimonial data, for example: debts, own house, income, among others; and, (y) information regarding different abilities: (y1) type of disability.
We process the following Sensitive Personal Data: i) health status; ii) patrimonial data, such as (a) financing or personal loans (house, car, etc.) and, (b) debts with financial or credit institutions.
We understand that the personal data of third parties (for example, personal or work references) that you provide us, already have the authorization of their respective owners so that they are delivered to us and treated by us following this privacy notice.
The primary purposes applicable to Personal Data (the “Primary Purposes”) will be: (a) for Recruitment and Selection of Personnel; (b) assess whether they are qualified to perform a position or role and to communicate with candidates regarding available positions or services; (c) identify you as a prospective job incorporation and / or employee and / or service provider (professionals or salaries equivalent to fees) and / or commission agent; (d) carry out interviews, investigations, examinations, tests and analyzes (socio-economic, academic, psychometric and medical or those that are necessary for the position) of the candidates and / or employees and / or service provider and / or commission agent, carry out statistical reports, establish remuneration schemes and evaluate the performance and growth of the labor market; (e) generate job profiles and structures that allow increasing and improving the productivity of working conditions; (f) for administrative purposes; (g) attention to internal complaints and / or complaints and (h) storage.
The secondary purposes applicable to Personal Data (the "Secondary Purposes") will be (a) statistics; (b) marketing, (c) prospecting, and (d) internal indicators.
The confidentiality of Personal Data is guaranteed and they are protected by administrative, technical, and physical security measures, to avoid damage, loss, alteration, destruction, use, access, or undue disclosure, for example, Personal Data is in a database internal data, whose administration is through access codes that change periodically and whose access is restricted to authorized persons; confidentiality agreements with its staff, among others.
You have the right to access, rectify and cancel your Personal Data, to oppose their treatment (collectively, "ARCO Rights"). For this, it is necessary that you or your legal representative present a written request to exercise the ARCO Right addressed to the [human resources] area of Marhnos, responsible for the protection of Personal Data, located at the aforementioned address; In both cases, they must receive an acknowledgment of receipt, so that Marhnos is bound in this regard. Said request must contain the following information: (a) name (s) and surnames of you and your representative, if applicable; (b) email address to receive notifications; (c) a simple copy of the official photo identification of you or your representative, if applicable, the legal representation of the person who requests on your behalf; (d) existence of the representation, utilizing a public instrument or power of attorney signed before two witnesses, if applicable; (e) clear and precise description of the Personal Data to which you seek to exercise some of the ARCO Rights; (f) any element or document that facilitates the location of your Personal Data; and (g) signature of the Application by you or your representative.
In case of requesting the exercise of the right to (a) Rectification, you must indicate the modifications to be made and provide the documentation that proves and supports the request; and (b) Access; Marhnos will provide Personal Data via email and/or by appointment at corporate offices, at the option of Marhnos.
Within a maximum period of 20 business days from the acknowledgment of receipt of the request, the request must be attended and informed about the origin or inadmissibility of the same utilizing a notice sent to the email provided to receive the notification or personally at the Marhnos facilities. If your request is appropriate, Marhnos must make it effective within the following 15 business days, counted from the receipt via email of the origin of your Request.
In addition, to the procedure for the exercise of the ARCO Right, you have the right, to the Secondary Purposes to (a) revoke or express your refusal to process your Personal Data; and/or (b) be included in the "Exclusion List" enabled and owned by Marhnos that allows us to limit the use and disclosure of Personal Data. For both purposes, just send us the request to revoke or be excluded, which must contain: (a) name (s) and surnames; and (b) email account to respond to your request, it must be directed to the Human Development area of Marhnos, receiving an acknowledgment of receipt so that Marhnos is bound in this regard. The acknowledgment of receipt includes proof of revocation and/or registration to the "Exclusion List". Marhnos has a maximum period of 5 business days to respond.
All documentation must be sent in PDF file format, legible and complete so that Marhnos can attend to the Request.
If you consider that your right to protection of personal data has been injured by Marhnos or you presume that in the processing of your data there is a violation of the provisions provided for in the Law, you may file your complaint or corresponding complaint with the National Institute of Transparency, Access to Information and Protection of Personal Data (INAI) https://home.inai.org.mx/, within 15 days from the date on which you receive the response from Marhnos or the end of the 20 days from the date of the acknowledgment of receipt of the Request for the exercise of rights.
Marhnos is a group of personnel recruitment and selection companies, consequently, the Personal Data may be transferred to subsidiaries, affiliates, affiliates, controllers, commercial allies and/or third parties, all of the human resources sectors, within national territory or abroad, for the same purposes mentioned, especially for recruitment and selection of personnel. Likewise, it may be transmitted to the people mentioned below: public or private institutions that carry out research, examinations, tests, and analyses (socio-economic, academic, psychometric, and medical or those that are necessary for the position) and, any other public or private entity that is necessary to fulfill the purposes for which you contacted us.
